Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Kohls RCM Pawel Kohls, operating as AffKeeper ("Company," "we," "us," or "our"), registered at Lechicka 59, 61-695 Poznan, Poland, VAT ID: PL5542524133, concerning your access to and use of the affkeeper.com website, dashboard, API and our services (together, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Service.

2. Description of Services

AffKeeper is an affiliate and redirect link management tool. The Service includes:

• Cloaked, branded short links on your own or our domains, with click tracking
• Product-availability monitoring for supported marketplaces (e.g. AliExpress)
• Broken-link (liveness) monitoring for redirect links
• Automatic fallback rerouting when a monitored product becomes unavailable
• Email alerts, a web dashboard, an API, and a WordPress plugin

3. Account Registration

To access most features you must register for an account. When you register, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your password and account, including any API keys
• Accept responsibility for all activity under your account
• Notify us immediately of any unauthorized use

4. Subscription and Billing

The Service is offered on a free tier and on paid subscription plans. By subscribing to a paid plan you acknowledge and agree to the following:

• Recurring charges: Your payment method is automatically charged each billing period (monthly or yearly) at the rate shown at the time of purchase, until you cancel
• Billing cycle: Each billing period runs from the date of subscription (one month or one year)
• Price changes: We may modify pricing with at least 30 days' notice. Continued use after the change constitutes acceptance
• Upgrades: Plan upgrades take effect immediately; the price difference is prorated for the remaining billing period
• Downgrades: Plan downgrades take effect at the end of the current billing period
• Taxes: Prices are exclusive of applicable taxes (VAT), which are added based on your location

Payments are processed securely by Stripe. We do not store your payment card details on our servers.

5. Cancellation and Refunds

You may cancel your subscription at any time through your account dashboard or by contacting us.

• Cancellation: Your paid features remain active until the end of the current paid billing period. No further charges are made after cancellation
• Refunds: We do not provide refunds for partial billing periods. If you cancel mid-period, you retain access until the end of that period
• Data retention: After cancellation, your data is retained for 30 days before permanent deletion. You may request earlier deletion
• Exceptions: If you experience a significant service failure on our part, contact us to discuss a prorated credit or refund

6. Acceptable Use Policy

You are responsible for the destinations you cloak, redirect to, or monitor. You agree not to use the Service to create, shorten, redirect, cloak, or distribute links to any of the following:

• Illegal content: Any material that violates applicable law in your jurisdiction or in Poland/the EU
• Child sexual abuse material (CSAM): Any content depicting or promoting the exploitation of minors. This results in immediate account termination and referral to law enforcement without prior notice
• Malware, phishing, or fraud: Links to software designed to damage or gain unauthorized access to systems, deceptive pages impersonating other services, or any fraudulent scheme
• Deceptive cloaking: Using redirects or link cloaking to disguise a destination in order to evade the policies, review, or security systems of any platform, network, or marketplace
• Affiliate fraud: Cookie stuffing, forced or hidden clicks, self-referral, or misrepresenting the nature of a link or product to earn commissions in breach of an affiliate program's terms
• Spam: Distributing links through unsolicited bulk messaging or comment/forum spam
• Violence, terrorism, hate speech, or harassment
• Adult content where prohibited, or content that infringes third-party intellectual property rights
• Infrastructure abuse: Activities that degrade the Service for others, including excessive automated requests, scraping of our systems, or attempts to access other users' accounts or data

You are solely responsible for complying with the terms of any affiliate program or marketplace you participate in. We reserve the right to suspend or terminate any account that violates this policy, without prior notice and without refund. In cases involving illegal activity, we will cooperate fully with law enforcement.

7. Monitoring, Logging, and Law Enforcement

To maintain the security and integrity of the Service, we collect and retain:

• Login events: IP address, browser user agent, and timestamp for each login
• Account activity: Link creation, modification, and deletion events
• Access logs: Server access logs including IP addresses and request metadata

This data is retained for a minimum of 12 months and may be retained longer where required by law. We will disclose user data to law enforcement when required by a valid court order, subpoena, or legal process; where we have a good-faith belief that disclosure is necessary to prevent imminent harm; or where required by applicable law. We may proactively report suspected illegal activity — particularly CSAM or terrorism-related content — to the relevant authorities without notifying the account holder.

8. Account Suspension and Termination

We may suspend or terminate your account and access to the Service, with or without notice, for any of the following reasons:

• Violation of these Terms or the Acceptable Use Policy
• Non-payment of subscription fees after the grace period
• Suspected fraudulent or illegal activity
• Request by law enforcement or a government agency
• Extended inactivity (no login for more than 12 months)

Upon termination for cause, no refund is issued and data may be preserved for law enforcement purposes.

9. Third-Party Marketplaces and Affiliate Programs

AffKeeper is an independent tool and is not affiliated with, endorsed by, or sponsored by AliExpress, Alibaba Group, Amazon, or any other marketplace or affiliate network. Availability monitoring relies on data and APIs provided by those third parties, which may change, rate-limit, or become unavailable at any time and outside our control. We do not guarantee the accuracy, completeness, or timeliness of marketplace data. Your participation in any affiliate program remains subject to that program's own terms, which you are responsible for following.

10. Intellectual Property

The AffKeeper platform, its design, and branding are the property of Kohls RCM Pawel Kohls. You retain full ownership of the links, content, and data you create with the Service. You grant us the limited right to process that data solely to provide the Service (for example, to check a product's availability or the liveness of a link).

11. Data, Retention and Security

We implement industry-standard security measures to protect your data, which is stored on infrastructure located in the European Union. We take reasonable steps to keep the Service available and secure, but no online service can be guaranteed error-free, and you remain responsible for keeping your own records of critical links.

Analytics retention: click analytics are retained for the period included in your plan (for example 30 days on Free and up to 3 years on Agency; current windows are listed on the pricing page and in the documentation). When a downgrade, cancellation or expired subscription shortens your retention window, analytics data older than the new window is retained for a further 30-day grace period and then permanently deleted. Upgrading back within the grace period preserves the data. Amounts exceeding the new plan's limits block the creation of new items. Links exceeding the plan's link limit remain active for a 30-day grace period, are then suspended (they display a notice instead of redirecting), and if still suspended after a further 30 days are permanently deleted, with their short addresses released for reuse. Restoring the account within its plan limits at any time before deletion reactivates suspended links immediately. Links and domains within the plan's limits are never affected by a plan change.

12. Limitation of Liability

The Service — including availability and broken-link monitoring, alerts, and automatic fallback — is provided on a "best-effort" basis. Checks run on a schedule and may be delayed, missed, or inaccurate due to third-party data, marketplace changes, or technical factors. AffKeeper does not guarantee that every out-of-stock, removed, or broken link will be detected or reported, and is not responsible for lost affiliate revenue, sales, or commissions resulting from a missed, delayed, or inaccurate alert, or from a product becoming unavailable.

To the maximum extent permitted by law, AffKeeper shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service. Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Poland. Any disputes shall be resolved by the courts of competent jurisdiction in Poznan, Poland. For EU consumers, the mandatory consumer protection laws of your country of residence may apply.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by email and by updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the modified Terms.
